ScanLab Photogrammetry (referred to in these Booking Terms & Conditions as “ScanLab” or “agency”)
ScanLab policy prohibits the client from attempting to solicit or at any time in the future employ any of the models and/or associates introduced to them through ScanLab in any capacity. If you would like to work with any of our models or talent you must formally do so directly by contacting our booking department.
BOOKINGS
Minimum time for all bookings is 3 hours, unless otherwise agreed upon. Every 30 minutes thereafter is computed into the next hour. The Length of booking must be specified at the time of booking.
RATES
All model rates are negotiated separately. Any usage fees are to be discussed with the agency at the time of booking and any unauthorized “re-usage” by you for a period exceeding one year shall be billed to you automatically. A Day rate is for 8 hours. A half day is 4 hours. Any overtime is billed at time plus one half.
Overtime will apply at time and half for bookings before 8 am and after 8pm or after 8 hours, unless a special arrangement has been made with ScanLab.
LINGERIE
The client must specify the type of lingerie that the model is to wear or bring at the time of booking.Lingerie rate is double the hourly rate unless otherwise agreed upon with ScanLab. This rate will apply for transparent, brief, or translucent clothing. The client is required at all times to provide a closed set and private dressing room for the models to change in and out of their outfits.
WEATHER INTERRUPTION
First cancellation due to weather will be at half the rate with the understanding that the model will be booked within 10 days of the weather cancellation. If the client fails to notify the agency of cancellation, and model arrives at a booking, the client will be billed for the full rate unless a weather date is agreed upon at the time of booking.
CANCELLATION
Cancellations made with less than 24 hours notice will be charged to you at a full rate. If you cancel within a window between 24 to 48 hours notice a half rate will be charged to you. Saturdays, Sundays and Statutory Holidays are excluded from these calculations. The agency reserves the right to cancel confirmed bookings with more than 48 hours notice, with no charge.
RE-SHOOT
Any “re-shoot” is payable to us at 100% of the booking fee
USAGE
Photographs can only be used in the manner agreed upon, which was laid forth on the confirmation of booking. Additional usage fees can be negotiated with the agency.
INSURANCE
The client is responsible for the models’ safety while the model is at work. Clients are strongly advised to provide our models with insurance coverage when working on local and international locations. It is the client’s responsibility to carry out a risk assessment of the location, the equipment used and the work conditions. At the time of the booking any known risks to health and safety involving the project must be discussed with ScanLab.
PERMITS
The client is responsible for obtaining all permits associated with the project. If the client’s project does not abide by the laws of the country, state or province the models and ScanLab are not held responsible.
TRAVEL TIME
Travel time is billed at half the hourly rate. Preparation time, i.e.: makeup, hair and styling, will be billed at full rate. Fittings will be at full rate. (unless separately negotiated)
COMPLAINTS
If there is a complaint that arises, the complaint must be reported to the agency during the course of the booking, so the situation can be resolved immediately. Complaints will not be dealt with after the fact, and will in no way absolve a client’s responsibility to pay full negotiated rate.
AGENCY FEE
There will be a 15 % Agency service fee charged to the client on all bookings (unless otherwise agreed through contract), whether all inclusive or added on, this applies to all fees hourly and usage fees. All payments are invoiced by the agency to the client and will be paid to the agency. Payments are not to made directly to the model.
MODELS COMMISSION
There is a 15% agency commission due to the agency from the model.
PAYMENT
All payments are invoiced by the agency to the client and all cheques are to be paid to the agency. Payments are forbidden to be made directly to the model’s name. All bookings must be done and confirmed through either email or fax. The client is responsible for paying a commission fee for each booking and will be invoiced accordingly. The client is entirely obliged and liable to pay ScanLab Photgrammetry once the model has fulfilled the duties as per contract. Payment is due by the client to the agency regardless of any adverse situation that the client might encounter themselves to be in with such as but not limited to bankruptcy or any inability to pay. Lastly, the use of the photographs is prohibited by the client until payment of all fees has been made to ScanLab.
If the client fails to pay the amount due, in accordance with these terms and conditions, the clients shall not be permitted to use the photographs of the end product of the services rendered by the Model. Furthermore, the client shall be responsible to pay all expenses and costs incurred in recovering any outstanding monies, including debt collection fees or Solicitor’ costs, that may arise.
